1. Agreement to Terms

By accessing or using the services provided by American Privacy Forensics & Compliance ("APFCompliant," "we," "us," or "our") through apfcompliant.com, you agree to be bound by these Terms of Service. If you do not agree, do not use our services.

2. Description of Services

APFCompliant provides website compliance assessment, remediation, and monitoring services, including:

• Free Compliance Scan: An automated, surface-level assessment of your website for potential privacy, accessibility, and video privacy compliance issues
• Custom Compliance Quotes: Tailored remediation proposals based on your website's specific needs
• Remediation Implementation: One-time engagements to fix identified compliance issues
• Ongoing Monitoring: Subscription-based automated scanning to catch new issues over time

All services are described on the site and in individual service agreements.

3. Not Legal Advice

APFCompliant is not a law firm and does not provide legal advice.

Our compliance assessments, scan results, reports, and recommendations are for informational purposes only. They do not constitute legal advice, legal opinions, or attorney-client relationships.

Compliance assessments identify potential issues based on automated scanning — they may not capture every issue and should not be relied upon as a complete legal analysis.

We recommend consulting with a qualified attorney for legal advice specific to your situation.

4. Compliance Assessment

Our compliance assessment services provide an evaluation of your website. Important limitations:

• Results are an assessment and may not reflect your complete compliance posture
• A favorable assessment does not guarantee legal compliance
• A negative assessment does not necessarily mean you are in violation of any law
• Assessment results are for informational purposes only and should not be used as legal evidence without accompanying forensic documentation

5. Account and Contact Information

You agree to provide accurate information when using our contact form or service request. Specifically:

• You are responsible for the accuracy of the information you provide
• We may use the contact information you provide to respond to your inquiry and deliver requested services
• Providing false or misleading information may result in termination of service

6. Payment Terms

For remediation and monitoring services:

• Payment terms for remediation services are outlined in individual service agreements
• All fees are quoted in U.S. dollars
• Refund policies are specified in individual service agreements
• Quoted prices are based on the scope described in the quote; significant changes in scope may require a revised quote

7. Refund & Cancellation Policy

Remediation Services (Privacy Shield, Accessibility Shield, Full Compliance)

Full Refund Window: You may request a full refund within 48 hours of payment, provided no contractor has been assigned to your project and no website credentials have been submitted. Refunds are issued to the original payment method minus any payment processing fees incurred.

Non-Refundable After Work Begins: Once a contractor has been assigned to your project or website access credentials have been received by APFCompliant (whichever occurs first), the engagement is non-refundable. APFCompliant commits contractor time and resources upon assignment, and these costs cannot be recovered.

Completion Guarantee: If APFCompliant is unable to deliver the agreed-upon remediation — specifically, if the post-remediation verification scan does not confirm that the identified compliance gaps have been resolved — APFCompliant will continue remediation work at no additional charge until verification passes. If APFCompliant determines that the remaining issues cannot be resolved within a reasonable timeframe, you will receive a full refund of the remediation fee.

Resolution Services (Full Resolution Package)

Non-Refundable After Communication Initiated: Once the Limited Authorization for Compliance Communication (LACC) is signed and APFCompliant has initiated communications as your intermediary, the resolution fee is non-refundable. The professional services — including mediation facilitation, compliance documentation preparation, and correspondence — have been performed and cannot be reversed.

Cancellation Before Communication: If you cancel the Full Resolution engagement before any communication has been initiated on your behalf, you will receive a refund minus a $500 administrative fee to cover assessment, case setup, and documentation preparation already completed.

Compliance Monitoring

Monthly Plans: You may cancel your monitoring subscription at any time. Cancellation takes effect at the end of your current billing period. No refunds are issued for the current billing period. Your monitoring dashboard and alerts remain active until the end of the paid period.

Annual Plans: Annual monitoring subscriptions are prepaid and non-refundable. If you cancel during your annual subscription period, your monitoring will remain active through the end of the prepaid year. No partial refunds are issued for unused months.

Free Trial Periods: If your remediation purchase includes a complimentary monitoring trial period (e.g., 3 months included with Full Compliance), no charge is incurred during the trial. If you do not cancel before the trial ends, your subscription will automatically begin billing at the then-current monthly or annual rate.

General Provisions

All refund requests must be submitted in writing to team@apfcompliant.com. Refunds are processed within 10 business days of approval. Payment processing fees charged by our payment processor (Stripe) are non-refundable in all cases. APFCompliant reserves the right to modify this refund policy at any time. Any changes will apply only to purchases made after the modification date.

8. Intellectual Property

All content on this site — including text, design, logos, and scan methodology — is owned by APFCompliant. You may not reproduce, distribute, or create derivative works from our content without permission.

Compliance reports generated for you are licensed for your internal business use, including sharing with your legal counsel.

9. Prohibited Uses

You may not use our services to:

• Submit URLs you don't own or have authority over for scanning (except publicly accessible websites)
• Attempt to overload, hack, or disrupt our scanning infrastructure
• Resell or redistribute our compliance reports or scan results
• Use our scan results to harass or threaten other businesses
• Misrepresent APFCompliant scan results as legal findings or legal advice
• Submit false or misleading information in any form

10. Limitation of Liability

APFCompliant provides services "as is" without warranties of any kind. To the maximum extent permitted by law:

• We do not guarantee that our assessments will identify every compliance issue
• We are not liable for any damages arising from reliance on our scan results, reports, or recommendations
• Our total liability for any claim is limited to the amount you paid for the specific service giving rise to the claim
• For free services, our liability is limited to zero
• We are not liable for any indirect, incidental, consequential, or punitive damages
• We are not liable for any legal outcomes or regulatory actions arising from compliance issues on your website, whether or not identified by our assessments

11. Indemnification

You agree to indemnify and hold harmless APFCompliant and its officers, employees, and contractors from any claims, damages, or expenses arising from your use of our services, your violation of these Terms, or your violation of any applicable law.

12. Dispute Resolution

Any disputes will be governed by the laws of the State of California. Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at team@apfcompliant.com. If we cannot resolve the dispute informally within 30 days, disputes will be resolved in the state or federal courts of Orange County, California.

13. Changes to Terms

We may update these terms at any time. Material changes will be reflected in the "Last Updated" date at the top of this page. Continued use of our services after changes constitutes acceptance of the updated terms.

14. Severability

If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
